Commercial Courts in the Kingdom of Saudi Arabia are part of the first instant courts of the general judiciary in the Kingdom of Saudi Arabia and are responsible for ruling on all essential or ancillary commercial disputes, as defined by the Law of Procedure Before Sharia Courts. All their judgments are subject to appeal, with the exception of those rendered in cases decided by the Supreme Judicial Council.
The Commercial Judiciary used to be affiliated with the Board of Grievances, but in March 2016, it was separated from the board, and its duties were transferred to the Ministry of Justice, represented by the general judiciary. Commercial Courts specialized in commercial cases were also established at the time. In October 2017, the Ministry of Justice officially launched commercial court activities by establishing three commercial courts in each of the following cities: Riyadh, Jeddah, and Dammam. Moreover, specialized commercial tribunals within the general court ecosystem were founded, in addition to a number of specialized appeal tribunals in some cities of the Kingdom.
Cases of the Commercial Courts
Commercial Courts hear several cases, such as disputes arising among traders, cases filed against traders concerning commercial contract disputes, disputes between partners and companies, all cases and violations related to commercial laws, all cases and violations arising from the implementation of the Bankruptcy Law, intellectual property laws, other commercial disputes, and cases of compensation for damages arising from a case previously heard by the courts.
Commercial Courts are comprised of specialized tribunals, each consisting of one judge or more, as determined by the Supreme Council of the Judiciary.
Distribution of Commercial Courts in the Kingdom
Commercial Courts are distributed across several cities and governorates in the Kingdom, while three of them are located in Riyadh, Jeddah, and Dammam. A number of commercial tribunals specialized in general trials have been established in some provinces and governorates with no Commercial Courts, in addition to specialized appeal tribunals in a number of cities in the Kingdom.
