What Are the Jurisdictions of the Commercial Courts in the Kingdom?
The commercial courts in the Kingdom of Saudi Arabia were established by a decision from the Supreme Judicial Council. They have specialized jurisdiction and are considered first-instance courts. The Law of Commercial Court was established in 2020.
The commercial courts have jurisdiction over all lawsuits and violations related to commercial laws, all commercial disputes between merchants, lawsuits against merchants due to their commercial activities, disputes between partners in partnerships, bankruptcy and insolvency lawsuits, and all other commercial disputes.
Commercial courts are present in all regions of the Kingdom. Each case is filed in the commercial court located in the area where the dispute occurred, without transferring it to another commercial court in a different city. This is part of the rules of territorial jurisdiction in the judicial system, which determine jurisdiction based on the location of the incident. Thus, commercial courts have both specialized and territorial jurisdiction.
